The route does not remove the need for qualifying professional work, appropriate credentials, prearranged employment, Canadian citizenship for this comparison, and a temporary purpose. A procedural preference cannot fix a role that does not fit a listed profession.
Resolve substance before procedure
Have the employer and applicant agree on the actual duties, entity, duration, and credential evidence before discussing convenience. Tell counsel about current U.S. status and prior immigration issues, since these may affect the available steps.
If the advice favours a petition or admission request, ask which personal facts support that recommendation. Avoid treating the choice as a way to present different versions of the same job to different authorities. Responsibility for the qualification question sits with the applicant, even where an employer volunteers to gather transcripts and licences.
Hypothetical example: a land surveyor is told by a recruiter that a state registration will be arranged after arrival, so nobody checks whether the profession-specific qualification standard is already met. That standard is not waived because a hiring manager is confident. Ask counsel to state plainly which criterion the applicant relies on and which document evidences it, then have the applicant verify that document exists in their own hands.
Remember also that TN rests on Canadian or Mexican citizenship rather than permanent residence, and that self-employment is not permitted on this classification.
