How should family timing fit the new-office launch?

THE SHORT ANSWER

The company’s expansion date and each family member’s immigration position are separate planning questions. An L-1 transferee’s spouse and unmarried children under 21 may seek L-2 status. Coordinate housing, school and employment plans using actual documents and advice rather than assuming a filed petition authorises the household to relocate. Sequence the household against the business, because the two run on different clocks and only one of them is under the company’s control. Premises, incorporation and hiring can be advanced whenever the company chooses. A spouse’s employment, a child’s school place and the sale of a home cannot sensibly be fixed until the immigration position of each person is known. Put the family steps that depend on someone else’s decision at the end of the list, and the ones that do not at the front.

01

Separate the people and milestones

List the transferee, intended accompanying relatives and desired dates, then ask counsel what steps apply to each. Keep petition approval, admission or status and business opening distinct. A family’s preferred schedule can inform planning but does not establish that all members have completed the immigration requirements for the intended activities.

02

Check the spouse’s actual work position

USCIS describes spouses in valid L-2S status as employment authorised incident to status. Do not extend that rule to children or assume a pending application establishes it. Confirm the spouse’s status and acceptable employment-authorisation evidence before setting a job start; the principal’s new-office plan is not itself the spouse’s work document.

03

Plan around the limited initial period

The new-office initial stay is limited to one year, and subsequent plans depend on the actual immigration position. Keep school, housing and household commitments flexible where possible. Track each person’s documents with counsel and discuss the consequences of business delays instead of assuming an extension will automatically preserve the original moving plan.

04

What cannot be started early, and why

Only three household steps genuinely have to wait, and knowing which they are removes most of the anxiety from the rest. A spouse’s job start cannot be fixed until that spouse’s own status and employment-authorisation evidence exist, because the principal’s petition is not the spouse’s work document. A child’s enrolment cannot be finalised until the family’s arrival is more than a hope, since a released place is rarely recoverable. And the disposal of the family home should follow, not precede, confirmation of what each member may do, because it is the commitment that funds all the others and the hardest to reverse. Everything else — passports renewed, records gathered, quotations obtained, schools researched — can proceed immediately and should, so that the waiting steps are the only ones left when the position becomes clear.

05

Working backwards from the limited initial period

Build the first year’s plan backwards from the limited initial period, since that period is what actually constrains everything else. Hypothetical example: an HVAC controls integration group opens a U.S. office and schedules its hiring, its first installations and its family relocation as though the initial stay were open-ended, leaving the evidence that the office genuinely supports the role to be assembled at the last moment. The new-office initial stay is limited to one year, and what happens next depends on the actual position at that point. Work the other way: fix the date by which evidence of real operations must exist, set the operating milestones that will produce it, and only then place the household commitments around them. A launch schedule and an immigration schedule that were never reconciled tend to collide in the final quarter.
