IN THIS GUIDE · Renewal evidence and results against the original plan
Start with the E-2 eligibility and application overview
Replace projections with results where available
Collect current financial and operating records covering the enterprise’s real activity. Compare actual revenue, expenses and staffing with the earlier plan. Explain material differences candidly, including a delayed launch or changed customer mix. Reusing the original forecast without addressing experience can leave the most important current evidence out of the case.
Review continued qualifying activity
Identify the business the investor currently develops and directs and compare it with the approved activity. Acquisitions, mergers or other fundamental changes may affect eligibility and procedure. USCIS guidance requires approval of substantive changes to E-2 status; do not assume every development can be left until the next visa application.
Update ownership and control
Use the present ownership ledger and governance records, including transfers or new financing. The original nationality and control explanation may no longer describe the enterprise. If the investor’s role has changed, explain the actual responsibilities and authority. Prior approval is relevant history, not a substitute for evidence of continued qualification.
Separate renewal from extension of stay
A consular visa application and a USCIS extension of status are different processes. Check the investor’s current admission record, travel plans and the chosen procedure. Family members have individual records too. A valid visa does not override an earlier end date on an admitted stay, and travel plans need their own review.
The order a renewal file has to be built in
Work outward from nationality and ownership, because everything downstream depends on them. Establish first that the required treaty nationality is still held by the investor or by owners holding at least fifty percent, since a share transfer to a new partner can unsettle that before anyone reaches the financial statements. Fix the ownership ledger next, then the investor’s actual role in developing and directing the enterprise, then the operating record, then the marginality question, and only then the forecast for the period ahead. Two steps cannot start early: a new projection is meaningless until the previous one has been reconciled against results, and the procedural choice cannot be made until each family member’s current admission position is known. Building in this order also makes the eventual submission shorter, because each section rests on the one before it.
Where a substantive change belongs in the sequence
Substantive changes have their own place in the sequence, and it is earlier than most owners expect. USCIS guidance requires approval of substantive changes to E-2 status, so a fundamental change is not something to disclose for the first time at renewal. Hypothetical example: a geotechnical testing laboratory acquires a competing soils-testing business and merges the two operations, then continues trading for a year before its renewal comes round. By then the enterprise being described is not the enterprise that was approved, and the file has to explain a transaction retrospectively rather than prospectively. Raise a contemplated acquisition, merger, sale of a stake or change of business line with counsel while it is still contemplated. The advice may be that nothing further is needed, but that conclusion belongs at the start of the sequence, not at the end.
