Do dependants automatically receive the investor’s extension?

THE DIRECT ANSWER

Do not assume the investor’s extension or readmission updates family members who did not complete the corresponding process. Each person’s authorized stay and documents need review, especially when travel dates differ.

Check age and spouse evidence again

A spouse and unmarried children under 21 may qualify as dependants; a child approaching 21 needs timely individual planning rather than an assumption that prior status continues unchanged. A spouse in valid E-2 or E-2S status is generally work authorized incident to status, while children are not. Confirm current evidence and expiry dates before relying on continued spouse employment.

Stage the household steps against the principal’s, since some of them cannot begin until the principal’s position is fixed and others should not wait. A dependent application generally follows from the investor’s qualifying status, so it cannot sensibly be completed first; a child’s age question, by contrast, runs on its own clock and should be raised at the outset. Hypothetical example: a family behind a modular housing manufacturing venture plans the investor’s consular appointment for the spring and leaves the children’s arrangements until afterwards, without noticing that the elder child turns 21 in the interval.

Ask counsel at the start for a person-by-person order of operations with the earliest binding date on each. A spouse in valid E-2 status is generally work authorised incident to status; children are not, at any age.
