FOR SPECIALIST TEAMS · UXBRIDGEUxbridge

Your expertise.Across borders.

An extension should describe what the specialist now does and whether the qualifying business structure continues. This Uxbridge guide replaces reliance on the original petition with current work evidence, status records and a careful review of remaining time. Scope is the quiet problem in a renewal. L-1B carries the transferee’s specialised knowledge into a related entity for a limited period; it is not a general licence to place that person wherever the group finds work, and it is not a route to permanent residence. Knowing what the classification does not reach makes the extension evidence far easier to assemble. State the boundary in writing before the drafting starts.

IN THIS GUIDE · Preparing an L-1B extension from actual work

Start with the L-1B eligibility and application overview

01

Compare the approved and current roles

Read the earlier filing and identify changes in duties, products, supervisors, locations or clients. Explain the current work and why it still involves specialised knowledge. Do not assume the original description remains accurate after several project cycles. Material changes should be reviewed for any required immigration action rather than saved for the next routine renewal.

02

Document ongoing operations and knowledge use

Gather current business activity, employment and project evidence. Show the employee’s specialist contribution through selected work performed during the authorised assignment. If the original case involved a new office, the actual operating record is particularly important. Reusing initial forecasts without current evidence does not show how the business developed.

03

Review the available period of stay

L-1B generally has a five-year maximum, and prior H or L time can affect the calculation. Time abroad and exceptions require individual analysis and evidence. Assemble approvals, I-94 records and travel history rather than assuming a new employer or project starts the clock again. The requested period should reflect the reviewed calculation.

04

Coordinate dependent and travel steps

The principal’s extension does not automatically complete every dependent’s extension needs. Review each family member’s admission record, passport and planned travel, including a spouse’s employment documentation and a child approaching 21. Filing, continued stay, work and travel questions depend on the actual circumstances; do not infer them from a receipt alone.

05

What an L-1B extension does not carry with it

Four misreadings recur, and each is expensive in a different way. The first treats the classification as covering any role the group needs filled; it covers the specialised-knowledge position that the petition describes. The second treats a five-year period as guaranteed rather than as a maximum against which prior time spent in the United States in H or L status is counted. The third treats the extension as covering dependants automatically, when each family member has their own record and their own process. The fourth treats L-1B as a step toward a green card; it is a temporary classification, and any permanent-residence plan stands on its own requirements. Write these four boundaries at the top of the renewal file and check each proposed statement against them, because the drafting instinct is to claim more than the route delivers.

06

When the work has quietly moved to a customer’s site

Placement at a third party’s site is where scope questions bite hardest, because the commercial arrangement and the immigration description can drift apart without anyone noticing. Hypothetical example: an engineered timber products company extends a specialist whose approved role was internal process development, and over two years the work has become on-site troubleshooting for the buyers of its panels, directed largely by those buyers’ construction managers. The commercial logic is sound; the description in the original petition no longer matches. Offsite and third-party placement arrangements carry their own conditions, and the extension has to describe the work as it is actually performed and controlled. Ask the operations lead to write a plain account of where the specialist works, who directs the work and whose knowledge is being applied, then let counsel decide what that means for the filing.
