Is an L-1B extension automatic if the first case was approved?

THE DIRECT ANSWER

No. The employer must support continued eligibility and the requested period with current facts. Prior approval is relevant history, but changes in work, business structure or status can affect the extension.

Review the present case

Explain how current duties still involve specialised knowledge and document ongoing qualifying business and employment. Identify client-site or new-office developments rather than repeating outdated statements. Also review remaining time under the L-1B limit and relevant prior H or L stays.

A continuing commercial project alone does not establish that every extension requirement is met. Specialised knowledge is a claim about this person’s knowledge of this organisation’s products, services, research, systems or management, not a claim about seniority, scarcity in the labour market or how difficult the role would be to fill. Hypothetical example: an HVAC controls integration firm supports an extension by arguing that qualified commissioning engineers are hard to recruit locally.

That argument answers a business problem the classification does not address, and it leaves the actual question — what does this individual know about the company’s own systems that an ordinarily skilled engineer would not — unanswered. Rewrite the case around proprietary tooling, internal methodology or accumulated product knowledge, with concrete work examples. Recruitment difficulty may explain why the company wants the transfer, but it does not establish the requirement.
