IN THIS GUIDE · Moving from petition approval to consular documentation
Start with the EB-5 eligibility and application overview
Follow the official case instructions
After the petition stage, the National Visa Center and consular process require their own steps when the case is ready. Preserve government notices and use the instructions applicable to the assigned case. Do not assume a project’s approval announcement means an interview is booked. Visa availability and completion of required documents affect progression independently of investment performance.
Build individual civil-document files
Each intending immigrant needs relevant identity and civil evidence. Collect passports, birth and marriage records, and other documents required under the applicable country instructions. Identify name differences early and retain originals or acceptable certified copies for the interview as directed. The principal investor’s business file does not replace documentation establishing a spouse’s or child’s relationship and individual eligibility.
Schedule medical steps as instructed
Immigrant visa applicants need the required examination by an authorized panel physician and applicable vaccinations. Follow the official instructions about scheduling and documentation rather than booking an ordinary examination and assuming it will suffice. Keep medical and interview logistics linked to the actual case stage. Completing a medical examination does not guarantee visa issuance or eliminate other eligibility review.
Prepare an accurate interview history
Review the information submitted about the investment, family, residence and prior U.S. travel. Bring requested documents and answer accurately; do not memorize a project’s promotional script. Disclose relevant changes to counsel before the interview. Approval of the petition does not waive the consular officer’s review of visa eligibility, and some cases may require additional processing or documentation.
Which record settles which question
Map each requirement to the document that decides it, and write the mapping down. Identity and nationality are settled by the passport and, where names differ, by the record that links the two — a marriage certificate, a deed poll, a court order — not by an affidavit that merely asserts the connection. Relationship is settled by civil registration: a birth certificate naming both parents, a marriage certificate naming both spouses. Lawful source of funds is settled by a traceable chain running from the origin of the money to the capital placed at risk, with each link supported by a record that a stranger could follow. Medical eligibility is settled only by the examination performed through the authorised panel process. Where a required record cannot be obtained, the applicable country instructions describe what may substitute; that substitution is a defined path, not an improvisation.
Where a source-of-funds chain breaks
Source-of-funds evidence fails most often at a join, where one record hands over to the next. Hypothetical example: an investor who built an aggregate haulage business funds the investment from the proceeds of selling its truck fleet, and the file contains the sale agreement and the arrival of the money in the investment account but nothing showing how the buyer’s payment reached the seller’s own bank. The story is entirely honest and the chain still has a gap on its face. Lay the chain out as a list of transfers, each with a date, an amount, a paying party, a receiving party and the document that evidences it, then look for any row where the receiving party of one line is not the paying party of the next. Capital must be placed at risk, and guaranteed repayment is incompatible with that requirement, so any repayment arrangement in the documents deserves a direct question.
