Does EB-5 petition approval guarantee an immigrant visa?

THE DIRECT ANSWER

No. The consular stage includes separate application, documentation, medical and eligibility requirements, and visa availability matters. Petition approval does not remove the review of each intending immigrant’s admissibility.

Prepare for the actual next stage

Follow the government notices for the case and provide counsel with relevant family or immigration changes. Complete civil records and the required medical process as instructed. Avoid assuming that project completion or another investor’s interview fixes your schedule.

A visa is not issued merely because capital was invested, and travel plans should reflect the family’s actual issued documents and instructions. Every condition at this stage has a record that decides it, and an approved petition is not that record for any of them. Petition approval evidences the investment case; it does not evidence a spouse’s relationship, a child’s age, a medical result or admissibility.

Hypothetical example: a family whose capital went into an engineered timber products mill arrives at the consular stage assuming the approval notice speaks for the household, and the derivative applications then stall for want of a marriage certificate in an acceptable form. Ask counsel to list every eligibility point being asserted for every person, and name beside each the document that will prove it. Where no document exists yet, that item is an outstanding action, not a detail; conditional residence and the later petition to remove conditions lie beyond this stage and have their own evidence.
