Does choosing an employer petition also settle my family’s TD process?

THE DIRECT ANSWER

Do not assume it does. Each family member’s nationality, location, current status, and relationship evidence need review. The principal worker’s petition and the family’s visa, admission, or status steps may be separate parts of the plan.

Map the whole family sequence

Ask counsel to identify what each person must do and what evidence of the principal’s status is needed if dependents join later. Canadian and non-Canadian family members may have different visa requirements. TD status itself does not authorize work, regardless of the principal’s route.

Compare travelling together with a later family arrival only after identifying the remaining steps; a petition decision is not a promise that everyone can relocate on the same date. Each dependant is their own applicant, which changes who must be present and who can act for whom. A parent cannot answer eligibility questions on behalf of an adult family member, and an employer has no role at all in a dependant’s case beyond confirming the principal’s employment.

Hypothetical example: a forester accepts a role and assumes the employer’s immigration coordinator will handle the spouse’s and children’s arrangements as part of the package; the coordinator’s mandate covers only the worker. Establish early whether anyone is retained for the family’s steps and, if not, who will be. TD status permits study but does not authorise employment, so a spouse expecting to work needs separate advice about what, if anything, would.
