Can a spouse help operate the franchise?

THE DIRECT ANSWER

A spouse in valid E-2 or E-2S status is generally work authorized incident to status and may have a role in the business. That possibility does not establish the principal investor’s own authority to develop and direct it.

Document both roles accurately

Show the investor’s decisions separately from the spouse’s planned duties, especially if the operating forecast depends on both people. Confirm status and employment-verification evidence before work begins. Unmarried children under 21 may seek dependent status, but it does not authorize their employment.

Do not use an assumed family labour arrangement to conceal the franchise’s real staffing costs. Where a spouse will work in the business, document their role as a role: duties, hours, terms and remuneration, recorded as they would be for an unrelated employee. This matters more in a franchised operation than founders expect, because the staffing model is often built around family involvement and the enterprise's capacity may be assessed accordingly.

A spouse’s work authorization is incident to valid E dependent status and lasts only while that status is maintained. Keep the household's finances separate from the unit's from the first day, since franchise operations commonly handle cash and an unclear boundary complicates both the business records and the funding narrative. Children may accompany as dependants while unmarried and under 21 and cannot work in that status, so their help should not appear in any staffing plan.
