IN THIS GUIDE · Canadian permanent residence and the TN citizenship requirement
Start with the TN eligibility and application overview
Establish citizenship rather than residence
Begin with the citizenship you hold today. TN is available to eligible Canadian or Mexican citizens, and Canadian permanent residence alone does not satisfy that threshold. A permanent resident who is already a Mexican citizen should assess the Mexican TN procedure rather than assume Canadian residence creates the Canadian process. Place of birth, years living in Canada and a Canadian address should not be used as substitutes for determining present citizenship.
Keep future citizenship plans conditional
An intention to seek Canadian citizenship is a future possibility, not current TN eligibility as a Canadian citizen. Ask the employer whether its recruitment timeline can accommodate that uncertainty. Canadian citizenship requirements and application progress need separate review using current Canadian government information. Do not predict an oath date from a U.S. start date. The practical decision is whether the offer can remain viable without representing an unfinished citizenship process as complete.
Screen the profession before making promises
Even if the citizenship threshold may later be met, the offered work still needs its own assessment. Review the listed profession, education or permitted alternative credentials, real duties, prearranged employment and temporary plans. This preliminary analysis can identify a second obstacle before anyone assumes citizenship will solve the entire case. Clearly label it as advance planning: a favorable professional assessment does not remove the nationality requirement or authorize work in the United States.
Choose a present-day employer conversation
Explain what you can document now and what remains uncertain. If TN is not currently available, ask for review of other employment routes based on their actual requirements, without implying that another option must exist. Discuss whether a delayed offer is commercially possible. Keep Canadian residence and citizenship questions distinct from U.S. work permission, and obtain appropriate advice before making cross-border work arrangements. No pending citizenship application creates U.S. employment authorization.
Know what citizenship evidence actually looks like
Confusion in this area is often a documentary problem before it is a legal one, so establish what each card in your wallet proves. A permanent resident card evidences status in Canada and says nothing about citizenship. A Canadian citizenship certificate or a valid Canadian passport is what evidences Canadian citizenship. A provincial health card, a driver's licence and a social insurance number evidence none of it. Where a person naturalized some years ago and has never obtained a passport, the certificate is the document to locate, and replacing a lost one takes time. Hypothetical example: an urban planner who has lived in Canada for a decade as a permanent resident holds no document that would support a TN request on the basis of Canadian citizenship, however long the residence has been and however settled the person's life is.
Handle the start-date conversation while the basis is unresolved
The practical difficulty is rarely explaining the rule; it is managing an employer that has already begun planning. Offer a structure rather than a refusal. Ask whether the offer can be made expressly conditional on a route being confirmed, whether the start date can be expressed as a window rather than a fixed day, and whether the company would consider an alternative basis assessed on your present nationality. Put the current position in writing so that nobody later relies on a misunderstanding, and identify who at the company needs to know rather than assuming a recruiter will pass it on. Where the employer is unwilling to proceed on any basis other than an assumption that is not correct, that is information about the employer, and it is better obtained before any commitment is given up.
