What if an L-2 spouse’s I-94 does not clearly show spouse status?

THE SHORT ANSWER

Qualifying L-2 spouses are employment authorized incident to valid status, but the evidence needs to be understood correctly. An unexpired L-2S I-94 is List C employment-authorization evidence. If the record is unclear or unexpected, seek appropriate review rather than assume the principal’s approval or the visa label resolves it.

01

Read the actual admission record

Check the spouse’s own I-94, including the name, classification and admitted-until information. Compare it with the circumstances of admission and relevant supporting documents privately. Do not substitute the principal’s record or rely only on a visa sticker, because the question concerns the spouse’s actual status and evidence available for employment verification.

02

Identify the precise documentation issue

Explain whether the concern is an apparent coding error, an older record or a mismatch between documents. USCIS guidance recognizes specific older-record evidence arrangements as well as L-2S records. Have the actual documents reviewed rather than assuming that every I-94 showing an older label is either sufficient or necessarily invalid.

03

Coordinate with employment verification

An eligible unexpired L-2S I-94 establishes List C evidence; it does not by itself supply all Form I-9 identity requirements. The employer must follow the applicable verification rules. Seek clarification through the appropriate process before relying on an unresolved record, without assuming an EAD is mandatory for every qualifying L-2 spouse.

04

Establish what the record says before deciding it is wrong

Start by obtaining the actual admission record rather than relying on a recollection or a photograph of a stamp. Retrieve the electronic record from the official source and read exactly what it states: the classification recorded, the admission and expiry dates, and the name and details as entered. Compare it against the passport and the documents presented at admission. Some apparent problems turn out to be transcription differences or a misreading of the format, and those are resolved differently from a genuine error in the classification recorded. Print or save the record as it stands, with the date retrieved, before anyone attempts to have it corrected, so that the original position is documented.

05

Separate the correction from the employment decision

Two things need doing and they run on different tracks. The first is having the record corrected through the appropriate official channel, which takes whatever time it takes. The second is deciding what the spouse does in the meantime, and that decision belongs to them and their prospective employer rather than being deferred until the paperwork resolves. Establish with counsel what the spouse's actual position is on the underlying facts, since that is what matters, and what evidence would satisfy an employer's verification requirements. Where an employer is unwilling to proceed pending the correction, that is a commercial position to plan around. What should be avoided is beginning work on an assumption about status that the record does not currently support.
