Read the general eligibility basics overview
Yes, Mexican citizenship can meet TN’s nationality requirement even when the person lives in Canada as a permanent resident. The profession, role and qualifications still need review. Mexican and Canadian citizens do not follow identical TN visa procedures, so Canadian residence should not determine the preparation instructions.
State the correct basis
Describe the applicant as a Mexican citizen residing in Canada, with Canadian permanent residence as a separate fact. That avoids both incorrect conclusions: that every Canadian PR is excluded from TN, or that residence permits use of the Canadian-citizen procedure. The relevant nationality must be established with appropriate evidence during detailed preparation.
Review the professional proposal
Organize the employer’s duty description, the profession being considered and the applicant’s qualifications. Citizenship opens the nationality question; it does not establish that the offered position fits TN. Ask the employer to clarify ambiguous responsibilities before investing effort in a package built around a category name or a familiar job title.
Use the appropriate procedure
USCIS distinguishes Mexican citizens’ TN visa process from Canadian citizens’ ability to request TN admission without a TN visa. Confirm current consular instructions for the actual applicant rather than copying a Canadian colleague’s border checklist. A Canadian PR card does not change the person’s citizenship or eliminate the need to review the correct procedure.
Expect a different procedure, not a different standard
Where the basis is Mexican citizenship, the substantive requirements are the same ones that apply to any applicant in the category: a listed profession, the credential that profession requires, prearranged professional employment with a U.S. employer, and a temporary purpose. What differs is the route by which classification is sought, since the procedure available to Canadian citizens is not the same as the one Mexican citizens generally follow. Establish the procedure early, because it affects where the application is made, what the employer must prepare, how far in advance the work must begin and how much of the timeline is outside anyone's control. Confirm the current process from official sources rather than from an account of how a colleague's application proceeded.
Explain the residence, and then set it aside
Canadian permanent residence will feature in the applicant's history and it is worth stating plainly, since a long period living and working in Canada explains employment records, professional registration and much else in the file. What it does not do is contribute to eligibility, and the two roles should not be allowed to blur. Present the residence as context for the career and the nationality as the basis for the category. Where an employer or an adviser has been treating the residence as though it carried weight, correct that in writing before anyone drafts a support letter around it, and make sure the correction reaches the person actually preparing the documents rather than only the recruiter who raised the question.
