Which franchise records strengthen an E-2 evidence file?

THE DIRECT ANSWER

Include the franchise agreement, payment evidence, ownership records, opening requirements and location-specific operating documents. Explain whether franchise, premises and supplier commitments are final, conditional or still under negotiation.

Distinguish support from proof of operations

Training schedules and franchisor materials help explain the model, but add actual site arrangements, equipment orders, licensing progress and a grounded financial forecast. Identify the investor’s management rights and responsibilities. If projected revenue relies on franchisor data, state what that data measures and how the proposed operation differs; do not present comparable outlets as this business’s achieved performance.

Collect the franchise documents in full rather than the summary provided during recruitment. That generally means the franchise agreement itself with all schedules, any disclosure document supplied, the territory definition, the approved supplier arrangements, the site lease and any franchisor guarantee or consent attaching to it, the equipment and build-out specifications and quotations, and the training obligations. Add the operator's own material: the funding evidence, the payments made and to whom, the entity formed and its ownership, and the local licences and permits required to trade.

Keep the franchisor's marketing material separate from the contractual documents, since the two often differ in emphasis and only one of them binds anyone. Where a document is a template that has been varied for this operator, ensure the executed version rather than the standard form is what goes into the file.
