Can a spouse start a U.S. job while the Gold Card case is pending?

THE DIRECT ANSWER

A pending family plan should not be treated as work authorisation. Ask counsel what status or documentation supports the spouse’s proposed work and when it takes effect.

Coordinate the job offer with the case

Identify the intended start date and any existing immigration position accurately. The reviewed programme summary does not supply a general interim work-permission rule. Do not assume inclusion in the principal’s application, payment of family charges or an expected approval date answers the employer’s authorisation question.

The costliest household mistake is a second resignation. When one partner leaves a job on the strength of the principal’s pending case and the other follows, the family removes both incomes and both sets of benefits before anyone holds a document permitting work. Hypothetical example: the spouse of an applicant who runs a landscape contracting firm accepts a U.S.

role with a start date chosen to suit the employer, resigns locally, and then learns that no work authorisation exists for her yet. Recovering from this is slow: the offer may lapse, the former employer may have filled the post, and the household is carrying relocation costs with nothing coming in. Stagger the exits instead, hold one income intact until counsel confirms in writing what each adult may lawfully do and from what date, and tell any prospective employer the honest position rather than a hoped-for one.
