What makes an EB-5 file ready for counsel’s final review?

THE DIRECT ANSWER

It should connect the investor’s lawful funds to the enterprise, identify the applicable structure and job evidence, and present accurate family and immigration facts. Readiness is a legal assessment, not a count of uploaded documents.

Make uncertainty visible

Provide an evidence index and a concise chronology with references to the underlying records. Mark projections and missing items honestly. Counsel should review whether the requirements are supported and which steps remain before filing.

Independent financial diligence should have its own documented scope. A complete-looking folder cannot establish eligibility when the documents do not prove the facts the petition requires. Completeness is the most common false signal in these files.

Volume grows because every attachment is kept, while the one record that would settle a contested point — the deed, the resolution, the tax assessment — was never requested, and its absence is invisible among a large collection of pages. Index by requirement rather than by folder and the hole becomes obvious. Hypothetical example: an investor backing a video post-production facility supplies a long run of bank statements showing an accumulating balance but nothing explaining the early deposit that started it; the file is thick, the lawful-source chain has no beginning, and the omission survives review precisely because the folder looked substantial.

Test each requirement against a named document, never against the size of the file.
