Who will monitor the obligations after a route is chosen?

THE SHORT ANSWER

The choice between EB-5 and Gold Card should include who manages the work after the first submission. EB-5 involves investment and immigration follow-up, while Gold Card requires its own correspondence and any applicable corporate administration. Define ownership of records and future decisions instead of assuming the initial adviser engagement covers everything. Nobody inherits this work automatically, so settle the order in which oversight passes from one holder to the next before the first submission is made. The sequence itself matters: whoever assembled the file usually leaves the arrangement first, an adviser’s engagement ends next, and the obligations continue after both. Establish who picks up each thread, and at what point they do it.

01

List the ongoing tasks by route

For EB-5, identify project reporting, investor records and preparation for later immigration steps, including conditions removal. For Gold Card, identify official notices, remaining adjudication steps and corporate ongoing terms where relevant. Use the actual arrangement rather than inventing a standard reporting calendar that the reviewed sources do not establish.

02

Assign responsibilities explicitly

Record who monitors correspondence, retains original documents, obtains project information and coordinates professional advice. Clarify which services are included in the engagement and what requires a separate instruction. A family member or company coordinator may organise tasks, but that role should not be confused with legal representation or authority to decide immigration consequences.

03

Plan for changes and handoffs

Preserve a current case summary if an adviser, employee or household coordinator changes. Seek advice before acting on material developments in the project, sponsorship or family plan. A well-maintained file helps the next review, but administrative diligence cannot guarantee project returns, continued eligibility or a particular outcome under either route.

04

First submission is a milestone, not an ending

First submissions close one phase and open another, and the tasks that follow arrive in an order rather than all at once. Correspondence comes before any response is prepared; a response comes before the next stage; and under EB-5 the later petition to remove conditions follows a period of conditional permanent residence that cannot be brought forward to suit anybody’s convenience. Map the sequence so nobody waits on a step that has not been reached, and nobody misses one because it arrived earlier than expected. Knowing what comes next is what turns an official notice into an action rather than an alarm. Put the sequence in writing while the first phase is still fresh.

05

Handover, in the order it has to happen

Handover works when the summary exists before the person leaves, not afterwards. Write the case summary while the departing holder can still explain it, transfer custody of the originals next, then confirm that the successor can genuinely retrieve correspondence and reach the advisers. Performing those steps out of order produces a file nobody can open and a contact list nobody answers. Hypothetical example: an investor in a drone-imaging services project relies on a coordinator who departs before writing anything down, and the successor spends a long stretch rebuilding a chronology that already existed in somebody’s head. Fix the order of the handover while the handover is still voluntary.
