Ownership through an estate does not automatically confer E-2 status on relatives. Each proposed principal or employee needs the applicable eligibility analysis, and dependent status is limited to a spouse and unmarried children under 21.
Keep inheritance and immigration relationships distinct
A spouse in valid E-2 or E-2S status generally has work authorization incident to status; dependent children do not. Parents, siblings and other beneficiaries do not qualify as dependants simply because they share the business. Review the actual ownership and roles separately, including the rule that inheritance of a business itself does not constitute an investment.
Marriages, separations, births and ownership transfers happen on their own timetable, and each can carry a status consequence. A child who marries, or who passes the age limit for dependent status, is no longer eligible as a dependant however the estate is arranged. A separation may alter both the household plan and, where ownership is shared, the nationality analysis supporting the case.
Hypothetical example: A grain brokerage inherited by two siblings is restructured so that one takes full ownership, and the other family’s assumption that they would hold dependent status through the business turns out to have had no basis at any stage. Tell counsel about these events as they occur. A spouse in valid E-2 status generally has employment authorisation incident to status; children do not, and no change in the business alters that.
