What if I am already in the United States when my work plans change?

THE SHORT ANSWER

Canadian PR does not answer what you may do while already in the United States. Identify your current admission or status and the new activity being proposed. Have the transition reviewed before beginning work or assuming that a future visa application, pending request or employer offer changes current permissions. The costliest error in this situation is acting first and asking afterwards. Beginning duties, accepting payment or travelling on an assumption can create a problem no later application resolves cleanly, and unwinding it is slower and far less certain than pausing would have been. A pending request is not permission, and an employer’s enthusiasm is not an authorisation.

01

Establish the current facts

Privately identify the documents associated with your current U.S. stay and the activity for which you entered. Record relevant dates and any subsequent action without guessing about their effect. The review needs an accurate present position before it can address a new role or business plan; Canadian residence is only one background fact.

02

Describe the proposed change

Explain what you now want to do, when the idea arose and who is asking you to begin. A new employment offer should not be treated as authorization to perform duties. The appropriate procedure can depend on the current circumstances, so generic instructions for someone applying from Canada may not fit this situation.

03

Obtain review before acting

Ask qualified counsel about the current status and the lawful sequence for the intended activity, including any travel under consideration. This guide does not decide whether a particular change or extension is available. Keep the employer’s preferred timetable separate from a conclusion that work is currently permitted or that a pending request supplies authorization.

04

Where people go wrong while already inside the country

Several failures recur. Someone treats a change of employer as an internal matter because they are already present in the United States. Someone begins work on a start date chosen by the employer rather than by the process. Someone travels while a request is pending and finds the departure affected it. Someone relies on Canadian permanent residence where the category turns on citizenship, since TN is available to citizens of Canada or Mexico rather than to permanent residents of either. Hypothetical example: A grain brokerage recruits a candidate already present in the United States in another capacity and asks her to begin covering trades during her notice period, before anyone has established what her current admission permits.

05

The cost of repairing a false start

Repair is rarely a single step. A period of unauthorised activity may need explaining in every subsequent application, by the individual and sometimes by the employer. Options that would have been straightforward can narrow, and a plan that assumed a clean record may require a different approach or a departure and application from outside. The commercial cost lands too: a role held open, a project reassigned, a family arrangement built around a start date that then moves. Ask counsel what the sequence should be and what evidence supports each step, then let the employer’s timetable adjust to it. Where an error has already happened, disclose it fully at the first review rather than letting it surface later in a document nobody controlled.
