What should a useful route-comparison decision record contain?

THE SHORT ANSWER

A sound comparison ends with reasons and unresolved questions, not a universal winner. Record the applicant’s objectives, household assumptions, legal assessment and financial consequences for each option. If a material issue remains open, define the next evidence or advice needed before treating either route as ready for commitment. The comparison is only as good as the evidence behind each line of it. For every statement placed in the record, whether about what a route requires, what it costs or what it exposes the family to, name the document or the adviser it came from and the date it was checked. A line without a source is an impression, and impressions are what make a comparison look decisive while resting on nothing.

01

Start with the objective

Describe whether the priority is permanent relocation, family participation, a particular business interest or another legitimate planning concern. Keep desired outcomes separate from confirmed programme benefits. EB-5 and Gold Card should be assessed against the same actual objective rather than allowing each proposal to redefine the applicant’s needs to favour itself.

02

Use evidence alongside each conclusion

For eligibility, availability, cost and financial exposure, record the adviser or official source supporting the assessment. Mark an unanswered question as unresolved, not as a low risk by default. Avoid a numerical score that implies precision where the source material cannot establish probabilities of approval, repayment or completion.

03

Choose the next action proportionately

The next step might be additional legal analysis, project due diligence, a corrected budget or a decision to pause. Record what would change the conclusion. An organised comparison can justify further investigation without implying that the applicant should pay into either programme simply because substantial research has already been completed.

04

Which document supports which line of the comparison

Eligibility statements should cite current official programme material, checked on a stated date, rather than a summary written by anyone selling either route. Financial exposure for EB-5 comes from the executed operating and subscription agreements with their amendments, since offering summaries describe the deal as marketed rather than as governed. Gold Card figures come from the official terms as published, remembering that the gift is paid by the individual applicant or a corporate sponsor, as applicable, to the Department of Commerce, deposited in a separate Treasury fund, and the processing fee is nonrefundable, a payment structure that is not an investment and cannot be compared to one on a return basis. Hypothetical example: A greenhouse produce growing owner compares the two routes on total outlay alone, and the comparison silently treats capital placed at risk and an outright gift as the same kind of number.

05

Mark the gaps as gaps

Unanswered questions should appear in the record as unanswered, with the person who could answer each one named beside it. The alternative, scoring a question as low risk because nobody objected, is how a comparison acquires false confidence. Distinguish three states plainly: verified against a source, advised by a named professional, and assumed. Assumptions are not forbidden, but they should be visible, because the decision often turns on one of them. Neither route offers assurance of outcome: ability to pay establishes neither eligibility nor admissibility, and capital placed at risk may not come back. Set a date to re-verify anything time-sensitive, since programme terms and project circumstances both change while a decision is being made.
