Can a regional centre promise that all my children are covered?

THE DIRECT ANSWER

No project provider can determine every child’s derivative eligibility from an investment subscription alone. Qualifying unmarried children and spouses must satisfy immigration requirements, and children approaching 21 need a specific age-protection analysis.

Review the family outside the sales process

Give counsel birth dates, marital status and relevant immigration history before relying on a family inclusion statement. Clarify which processing expenses a quote covers and which are per applicant. Regional-centre records support the project side of the case; they do not replace civil documents, individual admissibility review or the authorization needed for any work before residence.

Take family questions outside the sales process entirely and put them to counsel acting for you. A promoter's assurance that children are covered is not advice, and the person giving it generally has no responsibility for whether it turns out to be correct. Derivative eligibility depends on the relationship to the principal applicant and on requirements including age, assessed against each individual's own facts.

Where a child is approaching 21, raise it with counsel early, since statutory provisions addressing age calculation exist in some circumstances and their application depends on the facts including timing. Ask specifically about anyone whose position is not straightforward — an adult child, a stepchild, a child from a previous relationship — rather than accepting a general statement about families being included.
