Should a technical founder compare L-1B with E-2 rather than assume L-1A?

THE SHORT ANSWER

A technical founder may have a specialized-knowledge transfer question even if the proposed role is not managerial. L-1B and E-2 examine different facts: qualifying organizational knowledge and transfer history versus treaty investment and direction. Identify the actual work before deciding that every founder case should be presented as L-1A. Put transfer and investment facts in separate columns before choosing. A transfer needs an eligible organization, a full overseas year in the preceding three years, and a suitable L assignment. E-2 requires treaty nationality, a real non-marginal enterprise, capital placed beyond recovery at commercial risk, and investor control; it is not permanent-residence status.

01

Describe the knowledge and its use

For an L-1B assessment, identify the company-specific knowledge, how it was acquired and why the U.S. role requires it. Provide relevant work, training and project evidence alongside the qualifying foreign employment and corporate relationship. Technical competence or a founder title alone is not sufficient. Counsel should evaluate the knowledge standard and the actual assignment under the applicable rules. For transfer status, document the foreign employer, relationship, work dates, and role evidence. The maximum stay is seven years for L-1A and five years for L-1B.

02

Assess control and capital for E-2

For the investor route, document treaty ownership, qualifying capital and the authority to develop and direct the enterprise. Expertise in the product does not replace these requirements. Explain how technical work connects to business decisions and delivery. A strong specialized-knowledge narrative may inform the commercial plan but does not independently prove a substantial treaty investment. For E-2, document treaty ownership or control, source and use of capital, and operating authority. Technical ability cannot substitute for investment facts.

03

Compare the evidence burden honestly

List what supports the technical transfer and what supports the investment case, marking gaps in each. Avoid describing ordinary expertise as unique merely to strengthen a filing. Do not purchase unnecessary assets to substitute for missing investor control. The appropriate conversation follows the supported facts and intended role, with procedure and family planning reviewed only after the substantive options are understood. Hypothetical example: A reservoir-dredging contractor can transfer from a parent and also fund a U.S. operation. Decide whether the near-term role depends on corporate transfer facts or personal investor control.

A CONVERSATION IS A GOOD PLACE TO START.
