Can a client start date determine when the employee begins work?

THE DIRECT ANSWER

A commercial deadline does not authorise U.S. employment. The appropriate petition, visa where required and admission or status steps must support the work, and the final client arrangement must match the facts used to establish eligibility.

Clear the assignment before travel

Obtain the signed work scope and supervision details early enough for substantive review. If a project changes during processing, assess whether the existing filing remains accurate and whether further action is required. Keep mobilisation and family travel plans conditional; neither contract urgency nor optional premium processing guarantees approval or admission on schedule.

Clear the arrangement before travel is arranged, because a client's schedule and an immigration process answer to different authorities and only one of them can be moved. Establish that the contractual position, the supervision arrangements and the petitioner's deliverable are settled and documented before a start on site is promised. Where the engagement is still being negotiated, wait, since a description drafted against a draft contract may not match the agreement that is eventually signed.

Build in time for the client to respond to any request for confirmation, as that is outside the petitioner's control and frequently slower than expected. And agree what happens if the engagement is delayed or withdrawn after the employee has travelled, since that scenario is common and is far easier to plan for than to react to.
