THE DIRECT ANSWER

Company formation is only one step. The founder must already satisfy the relevant employment and other eligibility requirements, and the U.S. role must fit either the established-office or new-office framework.

Build the chronology before the launch date

Record incorporation, ownership transfers, employment dates and the start of actual U.S. business activity. If the founder previously worked as a sole proprietor, obtain a case-specific assessment of that history rather than backdating employment documents.

Allow time to secure required premises and support a realistic operational plan. Petition processing and any admission procedure remain additional stages after the evidence is ready. Incorporating creates an entity; it does not create the history the category examines.

The qualifying year abroad must already have been completed within the relevant preceding period, and a relationship between the businesses has to exist as a matter of fact rather than as an intention recorded in a resolution. Build the chronology before choosing a date: when the foreign business began operating, when the founder's qualifying employment ran, when the U.S. entity was formed, and when each element of the relationship came into existence.

Where the U.S. operation would be recently established, a distinct framework may apply to its first year and should be assessed rather than assumed. A launch schedule set for commercial reasons is a business plan, and it does not shorten or shape any part of the immigration process.
