When is a personnel-manager case ready to file?

THE DIRECT ANSWER

Readiness depends on whether the claimed role and supporting organization meet the applicable requirements at filing, not on when the company announces a promotion. Establish the relevant evidence before choosing a transfer date.

Use staffing changes carefully

Record when reporting lines and personnel authority became effective. For an established office, a plan to hire qualifying subordinates later may not establish the present role. New offices have a specific first-year framework that must be analyzed separately.

Build time for evidence review, government action and any travel procedure, while keeping the foreign-employment chronology consistent with the proposed filing. Work out which facts are still moving. A promotion taking effect next quarter, a subordinate who has resigned, or an entity restructuring that is mid-completion will each change the record between drafting and filing, and a petition describing a structure that no longer exists invites questions.

Fix a cut-off date, describe the organization as it stands on that date, and note any known change that will follow. Allow separately for the steps that come after a decision, since a Canadian citizen and a national of another country may face different procedures before the employee can actually be admitted and begin work. Neither an internal announcement nor an accepted start date creates authorization, so avoid communicating a transfer to a team before the position’s immigration basis has been assessed.
