Does my spouse have to work for my L-1A employer?

THE DIRECT ANSWER

An eligible L-2 spouse’s work authorization is incident to qualifying dependent status and is not limited to the principal’s employer. The spouse should establish that status and suitable employment documentation before starting work.

Keep two employment roles distinct

If the spouse joins the company, document their actual duties just as you would for another worker; their relationship to the manager does not prove a staffing claim. Check the spouse’s L-2S I-94 and acceptable identity evidence for employment verification. Unmarried children under 21 may qualify for L-2 but cannot work under that classification or be assumed available to staff the business.

Note that the spouse’s authorization depends on holding and maintaining the dependent status, so it ends if that status ends. If the principal’s employment changes or the L-1A period reaches its limit, the spouse’s ability to work is affected at the same time, which matters when a household has arranged two employers around one classification. Keep the marriage certificate and each child’s birth record in a form that can be produced quickly, with certified translations where the original is not in English.

For a child, watch the age: dependent eligibility under L-2 generally ends at 21, and a child approaching that age during a multi-year assignment needs a separate conversation well before the birthday rather than after it.
