L-1A connects a qualifying international business with a manager or executive needed in the United States. Start by testing the company relationship, foreign employment and actual U.S. responsibilities, then determine whether the operation is an established business or a new office. Naming the owner of each element early prevents the usual stall. Corporate records come from the company secretary or registrar, employment history from human resources abroad, the duty description from the receiving manager, and the classification assessment from counsel. The beneficiary supplies facts and cannot certify their own managerial capacity, and the final decision belongs to the adjudicating officer rather than to anyone assembling the file.

IN THIS GUIDE · L-1A transfer overview

01

Establish the international business

The foreign employer and U.S. employer must have a qualifying parent, branch, subsidiary or affiliate relationship. Ownership and control records explain that connection; incorporation alone does not. The business must maintain qualifying operations in the United States and at least one other country during the transfer, with a distinct initial framework for a new U.S. office.

02

Match the role to the category

L-1A concerns primarily managerial or executive work. Describe authority, decisions and who handles routine operations rather than relying on a title. The beneficiary generally needs one continuous year of qualifying foreign employment within the relevant three-year period. A new-office L-1A requires that foreign year to have been in a managerial or executive capacity.

03

Choose the correct office framework

A new office has been doing business in the United States for less than one year. Its evidence must address secured premises and the operation’s ability to support a managerial or executive position within one year of approval. An established-office petition instead needs evidence that the proposed role already fits the operating organization.

04

Plan beyond the first approval

Petition approval, any visa requirement and admission are separate steps. Track the actual admission record and preserve evidence of business activity and managerial duties for future filings. Initial new-office approval is limited to one year; L-1A generally has a seven-year maximum, with individual history and applicable exceptions requiring review.

05

Decisions that cannot be delegated to the applicant

Several determinations in an L-1A file look administrative and are not. Whether a role is primarily managerial or executive is a legal characterization drawn from the described duties, so a board resolution conferring a title settles nothing on its own; the same is true of an internal grade or a business card. Whether the two employers hold a qualifying parent, branch, subsidiary or affiliate relationship follows from ownership and control records, not from a group organization chart drawn for internal use. Whether the qualifying year abroad has been served is a question of dates and duties that human resources can evidence but only counsel can characterize. Assign each of these to a named person, and record who supplied the underlying record, because an adjudicator will test the statement against the evidence rather than accept the assertion.

06

When no one owns the corporate record

Gaps appear most often where responsibility is shared rather than assigned. Hypothetical example: A corporate secretarial services group runs the registers for several companies in a family of entities, and each local office assumes another office holds the share transfer records that would prove control between the foreign and U.S. employers. Nobody is withholding anything; the record simply has no owner. The consequence is a file that asserts a qualifying relationship it cannot evidence, discovered only when someone asks for the underlying instrument. Name one person accountable for producing the ownership chain and the documents behind it, give that person authority to request records across the group, and have counsel confirm that what arrives actually shows control rather than merely listing entity names.
