Read the general eligibility basics overview
A pending citizenship process is different from holding Canadian citizenship. TN is available to qualifying Canadian or Mexican citizens, not through Canadian permanent residence alone. Organize the current facts separately from the hoped-for change before an employer builds its offer or start date around TN.
Keep present and future facts separate
Record the citizenship you hold now, your Canadian residence status and the stage of any citizenship process. An expected future document should not be described as an existing qualification. This distinction gives the employer and adviser an accurate starting point without requiring anyone to predict when a separate government process will finish.
Review the offer independently
Ask the employer to confirm the real duties, required qualifications and proposed start window. Even after Canadian citizenship is obtained, those facts still need assessment under TN requirements. A future nationality change does not cure an unsuitable profession, unsupported credentials or a role that differs from what the employer actually needs.
Define when to revisit
Agree to revisit the route when citizenship is actually established or when the offer changes. Until then, ask whether another genuine pathway merits assessment on your current facts. Do not treat a tentative citizenship date as permission to work or as a promise that the U.S. process will fit an employer’s timetable.
Set the distinction out for the employer in writing
Employers frequently use permanent resident and citizen interchangeably, and the misunderstanding tends to survive a verbal correction. Put it in a short note: TN is available on the basis of Canadian or Mexican citizenship, and Canadian permanent residence, however long held, does not supply it. State what you actually hold today and what process is under way, without predicting its outcome or its completion date. This protects both sides. A company that has built a start date on a mistaken assumption is better served by learning it now, and an applicant who has corrected the record cannot later be said to have allowed it to stand. Where the employer’s own counsel is involved, address the note to them as well.
Identify what can genuinely proceed meanwhile
A pending citizenship application does not stop other preparation. The duties can be described accurately, the qualification evidence can be located and, if a credential requires an evaluation or a professional body’s confirmation, that work can begin. Equally, another route may be assessable on today’s facts: an employer with a related foreign entity, or a role fitting a different classification, may support a different analysis entirely. Ask counsel what your present nationality and circumstances actually permit rather than treating the pending application as the only variable. Keep any position offered on a contingent basis clearly labelled as contingent, and avoid arrangements that assume you will be able to begin work on a date nobody can currently commit to.
