IN THIS GUIDE · Personnel manager or first-line supervisor
Start with the L-1A eligibility and application overview
Identify the work beneath the title
List the employees directly supervised and what each actually does. A first-line supervisor of nonprofessional workers does not qualify simply by scheduling shifts or checking output. The analysis must establish the beneficiary’s primary managerial work and personnel authority, while taking the organization’s reasonable needs and development stage into account.
Show authority through decisions
Explain hiring, dismissal, promotion, leave and performance responsibilities with examples from ordinary company records. Where human resources formally signs a decision, document the manager’s recommendation role. A generic statement that the employee has full authority is less useful than a clear explanation of the decisions they can make and the limits on that authority.
Make the team chart verifiable
Connect the chart to employee records, positions and relevant professional qualifications. Distinguish existing staff from vacancies, and identify the source and date of the information. The objective is to show how the business actually operates, including who performs the work that the transferred manager is expected to oversee.
Resolve a weak personnel case honestly
If most duties involve supervising routine delivery or personally producing the service, identify that issue before drafting. A genuine function-management case may require a different analysis, but changing the label does not change the facts. Consider whether the proposed organization needs to develop further before the claimed managerial position exists.
Check the requirements that sit outside the job description
A convincing management narrative can still fail on a requirement that has nothing to do with duties. Four elements generally need to hold together. There must be a qualifying relationship between the foreign employer and the U.S. entity, such as parent, branch, subsidiary or affiliate. The employee must have been employed abroad continuously for one year within the three years preceding the petition or admission. That foreign employment must itself have been in a managerial, executive or specialised-knowledge capacity. And the proposed U.S. position must be managerial or executive for L-1A purposes. Time spent in L-1A is generally limited to seven years in total. Confirm each element with a different record — corporate documents for the relationship, payroll and personnel files for the year abroad — because a company that is confident about one element sometimes has never examined the others.
Test the chart against the payroll before drafting
Charts are drawn by people who know how the business is supposed to work; payroll records show how it actually paid people. Run one against the other before a letter is written. Look for subordinates who appear on the chart but were contractors, positions filled after the proposed filing date, and reports who moved teams without the chart being updated. Where the subordinates are genuinely professional employees, be ready to show what makes them professional — the qualification their role requires, not merely the seniority of their title. Hypothetical example: a proposed manager at an auto-parts distribution warehouse may supervise eight people, six of whom pick and pack; whether the remaining two are professional or supervisory employees is likely to matter more to the analysis than the headcount. If the reconciliation is uncomfortable, it is better discovered internally than raised in a request for evidence.
