L-1B supports qualifying intracompany transfers into U.S. work involving specialised knowledge. This Toronto overview brings together the company relationship, foreign employment, knowledge evidence, assignment, family and filing decisions before exploring a more focused situation. Few of these facts hold still. Between the first assessment and the eventual filing, an assignment can move to a client site, a product line can be retired, an internal reorganisation can redraw the group, or the employee can be seconded to a different entity. Each of those changes touches an element the case depends on, so build the file to be re-tested rather than simply finished, and record when each fact was last verified.

IN THIS GUIDE · L-1B specialised-knowledge transfer overview

01

Establish the transfer foundation

The U.S. and foreign businesses must have a qualifying relationship, and the organisation must meet the applicable doing-business requirements. The employee generally needs one continuous qualifying year of employment abroad within the relevant three-year period. Document the legal entities, employment dates and foreign duties before relying on a technical job title.

02

Explain special or advanced knowledge

The employee may establish special knowledge of the organisation’s products, services or other interests, or advanced knowledge of its processes and procedures. The evidence must explain the appropriate comparison and the employee’s actual capability. Knowledge need not be proprietary, unique or held by only one person, but general experience or unsupported labels are insufficient.

03

Connect knowledge to the U.S. work

Describe the duties and why they involve the employee’s knowledge. Use training, actual assignments and understandable technical evidence to support that connection. New offices have additional requirements. Primary placement at an unaffiliated worksite requires careful analysis of employer control and the specialised product or service, rather than treating an approval as general staffing permission.

04

Choose the procedure and household plan

Review individual or blanket eligibility, nationality, current status and the intended start date. Blanket L-1B requires a specialised knowledge professional. Eligible family members may seek L-2 through their own procedures. Confirm current fees and status dates, and separate preparation, adjudication and admission planning.

05

Which changes force the analysis to be reopened

Not every development matters, and telling the two apart saves rework. A change of U.S. worksite from a company office to an unaffiliated client’s premises reopens the control and specialised-service analysis, because primary placement at a third-party site is assessed differently. Retirement of the product or process at the centre of the knowledge claim reopens the evidence, since the claim must describe capability the organisation actually still uses. A corporate reorganisation that changes ownership between the two employers reopens the qualifying relationship, which must exist and continue through the transfer. By contrast, a new office address within the same entity, a revised salary or an added team member usually changes the description rather than the eligibility. Ask counsel which category a development falls into before assuming the packet can simply be reprinted.

06

Re-anchoring a knowledge claim after the work moves

Rewriting is cheaper than defending a description that has quietly stopped being true. Hypothetical example: A legal-process outsourcing provider prepares a transfer around an employee’s advanced knowledge of its internal review methodology, and then wins a mandate that places the same employee primarily at a client’s premises. The knowledge claim may survive, but the file now has to address who directs and controls the work day to day and whether the placement involves the provider’s own specialised service rather than the supply of labour. Reopen the assignment description, obtain the new contractual arrangement, and have counsel decide whether the change is compatible with the classification. If it is not, the honest options are to restructure the placement or to reconsider the route — not to file the earlier description and hope the difference goes unnoticed.
