What must an EB-5 applicant establish?

THE DIRECT ANSWER

The investor must meet capital, enterprise and job-creation requirements, with lawful source and path of funds evidence. Having sufficient net worth or purchasing U.S. property alone does not establish an EB-5 case.

Start with an eligibility map

Record the intended investment amount, enterprise, deployment arrangement and job-creation method. Then identify evidence for each requirement and distinguish documents already available from projections still needing support. Counsel should determine the applicable petition route and filing rules.

Financial suitability is a separate question for an appropriate independent professional; immigration eligibility does not establish that the investment suits the family’s needs. Establish the requirements in an order that lets each answer inform the next. Hypothetical example: An investor whose wealth came from a trade-finance advisory practice starts by shortlisting projects, then discovers that the partnership distributions funding the investment need supporting records from years of practice accounts, and that assembling them will take longer than the project’s subscription window allows.

Had the source-of-funds question come first, the shortlist could have been built around a realistic date. Work through capital amount and eligibility for any reduced threshold, then lawful source and path, then the enterprise and its job-creation method, then the filing route. Each answer narrows the next question, whereas choosing a project first fixes constraints before anyone knows whether the underlying eligibility can be evidenced at all.
