Can my spouse and children immigrate through EB-5?

THE DIRECT ANSWER

A spouse and qualifying unmarried children under 21 may seek derivative immigration benefits, subject to individual eligibility and applicable age-protection rules. They do not become residents merely because the investor files a petition.

Plan each person’s immigration stage

Obtain civil documents and review birth dates, marital status and previous U.S. immigration history. Children approaching 21 need a specific Child Status Protection Act analysis rather than an assumption that filing freezes age.

Once admitted or adjusted as permanent residents, family members have resident work rights; a pending investor petition by itself supplies no work authorization. Ages and civil records should set the family calendar, not a project’s closing date. Hypothetical example: An investor who built a legal-process outsourcing business plans the household’s move around a commercial closing while the eldest child is approaching 21.

The Child Status Protection Act analysis belongs at the front of that discussion, because it can determine whether waiting for a convenient transaction date costs a derivative the ability to immigrate with everyone else. Civil documents follow the same logic: birth and marriage records issued abroad, together with any translations, take as long as the issuing authority takes. Work through ages first, then civil documents, then the medical and consular steps that cannot begin until the petition stage supports them.
