A home sale does not itself establish or remove dependent eligibility. A spouse and unmarried children under 21 may seek E-2 dependent status, while the funding record must separately show ownership and control of the sale proceeds.
Plan the family move independently
A spouse in valid E-2 or E-2S status generally has work authorization incident to status; dependent children do not. Confirm each person’s documents and travel needs before tying relocation to the closing date. E-2 remains a nonimmigrant category requiring intent to depart when status ends, so do not present the sale as a promise of permanent U.S.
residence. Each family member is a separate applicant with a separate file, and no single adviser automatically holds all of them. The principal’s counsel may or may not be engaged for dependants; a school will verify enrolment but not status; a prospective employer of the spouse will want documentation the spouse must obtain personally.
Settle who is responsible for each person’s evidence before travel is arranged. Hypothetical example: the family of an investor opening a boutique hotel operations business assumes the principal’s preparation covered everyone, and discovers on the eve of departure that a child’s civil documents were never collected because nobody had been asked to collect them. Put a name against every applicant, not merely against the household as a unit.
