Can an investor travel after an E-2 change-of-status approval?

THE DIRECT ANSWER

Travel needs separate planning because a USCIS status approval is not a visa for reentry. A consular E-2 visa process and admission requirements may apply, depending on the person’s circumstances.

Review departure before booking around it

Confirm the status approval, passport, visa requirements and family records, and obtain advice if a request is still pending. Do not assume that a domestic processing estimate predicts a later consular appointment or passport return. Keep business operations covered lawfully while travel and immigration steps are unresolved.

Each dependant’s travel can also produce different documentation and admitted-stay dates. Cancelled travel is the usual first symptom that sequencing went wrong. A departure taken while a request is pending can be treated as abandoning it; a departure taken after approval still requires a visa before return, and the appointment calendar sits outside anyone’s control.

Both facts are knowable in advance, and both are routinely discovered after tickets are bought. Hypothetical example: a childcare-centre group’s founder plans a December trip to sign a lease abroad, having read the approval notice as a travel document, and the trip either cannot happen or restarts the process. The cost of getting this wrong is measured in months of an enterprise running without its investor, so put the travel question to counsel before the itinerary is fixed.
