IN THIS GUIDE · Resolving evidence gaps without changing the facts
Start with the L-1A eligibility and application overview
Identify the disputed requirement
Separate a company-relationship question from an employment-history, managerial-duty or operating-evidence question. Read the precise issue before collecting more material. A larger packet is not necessarily a stronger answer if it repeats the same unsupported assertion or addresses a different requirement from the one that needs clarification.
Build a fact-to-document map
For each issue, state the relevant fact and identify the existing record that supports it. Mark missing evidence and conflicting dates for review. Explain whether a document is historical or current; a revised chart may show today’s organization without proving that the same staff or relationships existed when the petition was filed.
Explain discrepancies transparently
A title change, delayed payroll update or different entity name may have a factual explanation. Obtain accurate clarification with supporting records where available. Do not alter original documents or create backdated evidence to make the file appear consistent. Counsel needs the real history to assess both eligibility and the appropriate response.
Keep the response tied to the case
If a government notice arrives, provide the complete notice and deadline to counsel promptly. A response should address its actual questions and explain the evidence’s relevance. More ambitious forecasts or newly assigned management language do not automatically establish eligibility at the original filing date, and expedited service does not cure an evidentiary gap.
The order the reconciliation has to follow
Reading the precise wording of the disputed requirement comes first, before a single record is requested. Second comes a written statement of the facts as they stood when the petition was filed, since the continuous qualifying year abroad, the managerial or executive character of the role, and the relationship between the two entities are all measured against that moment. Third comes retrieval of the dated records that already exist. Only after those three steps does drafting begin. Hypothetical example: a laboratory-instrument servicing group queried on managerial duties gathers three years of service-call logs before anyone has established which year the requirement turns on, and most of the material proves irrelevant. Inverting the first two steps is what produces a thick response to a question nobody asked.
Steps that cannot be started early
Drafting the narrative cannot sensibly begin until factual reconciliation is finished, because a narrative written first quietly decides which documents get selected. A revised organisational chart cannot be signed before someone has determined whether it describes the present organisation or the one existing at filing; a chart carrying today’s date and yesterday’s claim is worse than no chart at all. An interview with the beneficiary’s former supervisor abroad should precede, not follow, the summary of duties that supervisor is being asked to confirm. Submission waits until counsel has settled the deadline, the required format, and which of the assembled records genuinely belongs in the response rather than in the internal file.
