What should I do first when an L-1A evidence request arrives?

THE DIRECT ANSWER

Send the full notice to counsel promptly and identify the response deadline. Begin gathering the requested factual records immediately, while keeping track of current status and any planned travel.

Do not wait for a generic processing estimate

The notice’s instructions and the actual case control the response schedule. Ask which evidence is essential and who within the company can provide it. Preserve original records and flag gaps early so counsel can assess them.

A response may require clarification of historical facts, not merely a new business plan. Do not assume the request predicts either approval or refusal, or automatically extends authorized stay. Day one belongs to the notice, not to the evidence.

Read the stated deadline, record it, and have counsel confirm how it is calculated before assigning any collection work, because an internal target set casually a week later has caused more rushed submissions than any agency schedule. Collection then runs in parallel across the company, with a single named owner for each requested item. Drafting still waits.

Hypothetical example: a tutoring franchise splits its response between a finance lead pulling payroll and an operations lead documenting reporting lines, and the two streams converge a fortnight early, leaving counsel time to identify a remaining gap. Neither the schedule nor the response extends authorised stay, and the submission date is not a decision date.
