Your talent.A bigger stage.

A promotion, new employer, client assignment, or revised work location can raise questions after TN admission. This overview helps workers compare the proposed change with the arrangement that supported their status and identify what needs review before implementation. It does not assume that every change requires a filing or that an existing TN covers any new duties. Scope is the recurring difficulty here: a TN admission authorises a defined professional activity for a named employer, and none of it travels automatically to work that was not part of that arrangement. Treat the sections below as a map of where the existing authorisation stops rather than as permission to adjust the job first and ask afterwards.

IN THIS GUIDE · Reviewing changes to an existing TN work arrangement

Start with the TN eligibility and application overview

01

Recover the authorized baseline

Collect the employer letter, petition materials if applicable, approval documentation, and current I-94. Identify the employer, duties, profession, work arrangement, and period that supported the existing authorization. TN eligibility rests on qualifying citizenship, profession-specific credentials, prearranged professional employment, and temporary purpose; those fundamentals remain relevant after admission. A job title in an HR system may not describe the full authorized arrangement. Use the actual record as the starting point for comparing a proposed change.

02

Describe what will change in practice

Ask the manager for the effective date, revised duties, reporting line, work location, receiving entity, compensation structure, and employer identity. Mark what genuinely remains the same. A hypothetical promotion might retain the title family while moving the worker into substantially different responsibilities. Conversely, an address change may leave the employer and duties intact. These facts call for different analysis, so avoid assuming that the word promotion, transfer, or remote decides the immigration consequence.

03

Get the route and effective date reviewed

Changing or adding employers requires an authorization assessment before the new work starts. Ask counsel whether a petition, a new admission process, or another action is appropriate for the applicant’s nationality and status. The State Department guidance distinguishes a jobsite change with the same employer and duties from an employer change, but the full arrangement still matters. Do not infer blanket permission for remote work, outside clients, or new responsibilities from that narrow distinction.

04

Coordinate the business transition

Give HR and the manager a clear list of unresolved immigration questions and the date by which they need answers. Keep the existing and proposed roles separately documented so payroll changes do not silently precede legal review. If employment is ending or status expiration is close, seek prompt advice about the specific options and deadlines. This overview does not provide an automatic grace-period calculation or permission to work for a new employer while a request is pending.

05

What a TN admission does not carry with it

Nothing in a TN admission attaches to the worker as a portable credential. The status is tied to the employer, to a profession listed in the USMCA professional appendix, and to the arrangement described in the supporting materials, so adding a second employer, taking outside client work, or absorbing duties that fall outside the listed occupation all sit beyond what the current authorisation covers. Self-employment is not permitted at any stage, and a consulting agreement signed alongside the salaried job is not a neutral side arrangement. Citizenship of Canada or Mexico is the qualifying basis, never permanent residence, so a household whose Canadian immigration status has shifted should raise that first. Hypothetical example: a vocational counsellor admitted to deliver assessment services for one U.S. school district is asked to bill a neighbouring district directly, which is a second engagement rather than an extension of the approved one.

06

Misreadings that cause the most trouble

Four misreadings account for most of the damage. One treats the job title as the immigration fact, when the listed occupation and the duties actually performed are what matter. Another treats remote work, whether from Canada or from a U.S. home office, as invisible to the arrangement, when worksite and employer relationship were both part of what was described. A third treats a pending request as permission, which it is not. A fourth assumes TD dependants hold incidental work rights; they may study, but they cannot work. Every one of these is cheap to correct while the change is still a proposal, and expensive once payroll, a lease or a school registration has been built on top of it.
