Can an L-1B role include routine tasks?

THE DIRECT ANSWER

The analysis concerns the actual role and whether it involves the employee’s specialised knowledge. Routine tasks should be described honestly; their presence does not justify either automatic rejection or automatic qualification based on a few technical labels.

Explain the complete assignment

Identify which duties draw on the claimed special or advanced knowledge and support their substance with examples. Avoid inventing a numerical safe harbour or hiding general support work. If the role mainly fills an ordinary staffing need and the knowledge connection is weak, reassess the case rather than changing task names.

The other L-1B requirements remain necessary. Establish the qualifying year before the knowledge discussion opens, since one continuous year of employment abroad with a qualifying related entity during the three preceding years is a gate rather than a supporting argument. Duties come next, then the knowledge those material duties require, then the evidence for it.

Hypothetical example: a robotics integration firm settles on the employee it wants, describes an advanced cell-commissioning method in detail, and only afterwards finds a six-month gap in the foreign employment record that no description of the method can repair. A role built around knowledge the employee would acquire after arrival sits in the wrong order as well. Reviewing in this sequence reserves the expensive drafting for cases that have already cleared the threshold questions.
