The Vaughan guide focuses on making a complex EB-5 evidence file readable and verifiable. Missing originals, foreign-language records and different name spellings need honest explanations rather than cosmetic changes that conceal the underlying facts. Failures in a file of this kind are predictable and they cluster: a gap papered over with a declaration, a translation that covers part of a page, a name that appears three ways across four documents. Each carries a cost measured in months rather than pages, and each is far cheaper to prevent than to unwind once a request for evidence has arrived.

IN THIS GUIDE · Missing records, translations and inconsistent names

Start with the EB-5 eligibility and application overview

01

Create a gap list before drafting

List the facts the petition needs to establish and the records available for each. Identify missing bank history, incomplete sale documents or unavailable corporate records explicitly. Ask counsel what alternatives may be acceptable under the applicable evidentiary rules. A personal statement can explain a gap, but it should not be assumed to replace every required record without further support.

02

Translate complete documents

USCIS requires foreign-language documents submitted in support of a request to have full English translations with the required translator certification. A summary of selected pages is not the same as a complete translation. Preserve the source document beside its translation. Coordinate bank terminology, company names and transaction labels so translation choices do not create apparent contradictions in the funds chronology.

03

Explain genuine identity differences

Different transliterations, former names or document conventions can produce inconsistencies across passports, tax records and accounts. Collect appropriate evidence linking the identities and explain the real reason for the difference. Do not alter source documents or silently standardize a name in a way that changes the record. A clear index should help reviewers connect the documents while preserving their contents.

04

Control versions and corrections

Keep original records, revised records and explanations of corrections where relevant. Date the evidence index and identify who supplied each item. Secure access to sensitive financial and family documents should be limited to people handling the case. The goal is an accurate file that can withstand questions, not a polished narrative that hides uncertainty or unsupported assumptions from counsel.

05

The gaps that turn into requests for evidence

Gaps rarely announce themselves as gaps. They arrive disguised as summaries, screenshots and helpful reconstructions: a bank statement covering the months on either side of a transfer but not the transfer itself, a sale agreement without the payment that completed it, a company record showing present ownership but not the ownership held when the capital was earned. Each leaves a link in the chain unproven while looking complete at a glance. Hypothetical example: a freight brokerage owner documents the sale of a terminal that funded the investment, yet the archived statement showing the proceeds arriving was never retrieved, so the chain rests on a sale document and an assertion. Naming the missing link openly, with a record of what was done to obtain it, is stronger than a narrative that steps around it.

06

What unwinding a defective file costs

Unwinding is where the genuine expense sits. A defect found after filing is answered on somebody else’s schedule: a request for evidence sets its own deadline, records held by a closed bank or a former employer take longer to obtain than anyone plans for, and a document re-obtained abroad may need fresh certification and translation as well. Capital must remain at risk for the applicable sustainment period, and both conditional permanent residence and the later petition to remove conditions depend on records that were supposed to be settled earlier. Correcting a name inconsistency before submission takes an afternoon; correcting it afterwards means explaining the inconsistency and the change to it, in front of a reader who has already seen the first version.
