When is a reduced EB-5 amount a valid comparison point?

THE SHORT ANSWER

The reduced EB-5 figure applies only when its qualifying conditions are met. Compare it with Gold Card using the actual proposed investment category and current terms, not a universal discount assumption. The location of the applicant’s Canadian home does not determine whether a U.S. EB-5 investment qualifies for a reduced amount. Every comparison ages. A qualifying designation can change, a project can move, programme terms can be revised, and a household can gain or lose a member while the analysis sits in a drawer. Record the date of every figure and the condition it depended on, so that a later change appears as a change rather than as a quiet inconsistency between the plan and the world it was describing.

01

Identify the qualifying basis

USCIS currently describes US$1.05 million as the standard post-March 15, 2022 amount and US$800,000 for qualifying targeted-employment-area or infrastructure investment. Ask counsel what supports the reduced category in the actual proposal. A project label or a promoter’s assertion should not replace the applicable legal and documentary assessment.

02

Match the Gold Card scenario

Use the current individual or corporate gift and the same household assumptions for Gold Card. Its programme terms should not be altered by importing an EB-5 geographic category. Keep fees and family charges outside the principal headline comparison so a smaller capital figure is not mistaken for a complete route cost.

03

Refresh before committing

Record the review date and ask counsel to confirm the amounts and category when action is contemplated. USCIS describes future adjustments, so a current threshold is not a perpetual quote. The comparison should state the conditions underlying the figure without promising investment quality, visa availability or approval because the minimum amount is met.

04

When the basis for a figure moves

Re-verify the underlying condition rather than the number alone. A reduced EB-5 amount depends on the qualifying basis of the actual investment, so if the project, the location or the designation changes, the applicable amount becomes a fresh question instead of a rounding issue. Hypothetical example: a cold-chain distribution investor selects a project on one qualifying basis, the sponsor later relocates part of the development, and the assumption underneath the comparison has quietly changed. On the Gold Card side the gift is paid by the applicant to the Department of Commerce with a separate nonrefundable processing charge, and those terms should be re-confirmed before money moves rather than carried forward from an earlier note.

05

Household changes that reopen the comparison

Family facts move as well, and they reopen a comparison that looked settled. A child approaching an age limit, a marriage, a separation, or a decision to include a parent changes what each route entails and can change which is available at all. The two are not identical on household terms, so a change belongs back with counsel rather than resolved by analogy from the other programme. EB-5 capital must remain at risk for the required period, and conditional residence carries a later petition to remove conditions, so a change of plan has consequences well past the first decision. Note when each assumption was last checked, and check the oldest one first.
