A spouse in valid E-2 or E-2S status is generally work authorized incident to status and may have a management role, but that does not establish that the principal investor may work in a newly acquired or separate enterprise.
Review each person’s basis independently
Explain the spouse’s actual role and the investor’s approved activity, including any change that needs approval. Dependent children do not have employment authorization through E-2 status. If expansion affects residence or travel, check each family member’s documents separately.
Spouse work authorization should not be used as a shortcut around the principal’s enterprise-specific restrictions. Each person’s authority to work rests on a record that names that person. For a spouse, a qualifying E-2S I-94 or other applicable evidence establishes employment authorization incident to status; the principal’s approval says nothing about it, and neither does a company appointment letter.
Hypothetical example: an industrial coatings enterprise appoints the investor’s spouse as manager of a newly acquired plant and files the appointment in the corporate minute book, which records a company decision and proves nothing about immigration status. Children in E-2 status hold no employment authorization through it. Where one document is asked to do two jobs, separate them: one record shows the corporate role, another shows that person’s authorization to perform it.
A record naming only the company answers a corporate question and leaves the immigration one open.
