Must equipment arrive before E-2 preparation begins?

THE DIRECT ANSWER

Preparation can begin while transfer and installation are being planned, but the eventual evidence must show real commitment and credible proximity to operations. An intention to ship equipment later is weaker than documented completed arrangements.

Coordinate physical and immigration milestones

Track ownership, valuation, shipment, installation and required operating permissions separately. Identify who can lawfully oversee work before the investor’s admission and whether delays affect customer commitments. Government processing does not guarantee a delivery or opening date.

Update the business plan if key assets or their supporting facilities will not be available on the schedule originally assumed. Sequence the physical milestones and the immigration milestones on one chart, then look for the dependencies between them. Ownership and valuation can be completed early and sit within the investor control.

Shipment and customs clearance depend on third parties. Installation depends on premises being ready, and operating permissions often depend on installation being complete, which makes those permissions the item most likely to determine the real opening date. Identify who may lawfully supervise work before the investor is admitted, since that question is easier to solve in advance than to discover on site.

Preparation can proceed while these steps are pending, provided the eventual evidence shows real commitment and credible proximity to operations, because an intention to ship later is weaker than a completed arrangement. Update the plan, rather than the date, when a dependency slips.
