Read the general immigrant investor briefing overview
An available application process does not guarantee an immediately available immigrant visa. Ask counsel to assess the relevant category and personal facts for both proposals. Neither a Gold Card gift nor an EB-5 investment should be presented as buying exemption from the immigration availability rules that apply to the case.
Provide the facts that matter
Record citizenships, places of birth and family circumstances accurately. Canadian residence alone does not establish the availability analysis. Ask counsel which facts determine the relevant treatment, and retain the supporting records rather than adopting a timeline quoted to another applicant whose classification or personal circumstances may differ.
Identify the exact category
EB-5 proposals may involve different statutory categories and availability considerations; Gold Card identifies EB-1 or EB-2 as determined by authorities. Obtain a dated explanation using the current official information relevant to each option. This guide does not calculate chargeability, assign a queue position or publish a nationality-based completion forecast.
Keep the cost and timing decisions separate
A higher contribution, a different private fee or a more optimistic project presentation does not prove better visa availability. Compare the actual legal assessments and identify when they should be refreshed. Keep relocation commitments conditional where appropriate instead of converting a current general programme description into a guaranteed personal schedule.
Put the shared question first
The two proposals differ in almost every respect except one, and that one should be settled before either is examined in detail. Both depend on an immigrant visa being available to this applicant in the relevant classification, and neither the payment nor the investment removes that condition. Ask the availability question once, using the applicant own facts, and obtain the classification together with the date the assessment was made. Then examine the proposals separately, because from that point they diverge entirely. EB-5 requires capital placed at risk in a new commercial enterprise, generally the creation of ten full-time positions for qualifying U.S. workers, engagement by the investor, and a period of conditional permanent residence followed by a petition to remove conditions. The Gold Card, as currently described, is a gift made by the applicant to the Department of Commerce, deposited in a separate Treasury fund, and is not a conventional visa category. Comparing them before the shared condition is assessed compares two things that may both be unavailable.
Hypothetical example: three documents before any comparison
Hypothetical example: a household is presented with both options in the same meeting and asked to choose. A workable order is to decline the choice until three things exist in writing. First, the availability assessment, with the classification identified, the official information relied on and its date. Second, for the EB-5 proposal, the structure, the counting method and the identity of the party who will hold the records needed when conditions are removed. Third, for the Gold Card proposal, the current written procedure and schedule of what is payable, taken from the official materials rather than from a promoter summary. Only with those three does a comparison mean anything. Set a date to revisit the assessment, since terms as currently described may change, and keep relocation commitments conditional until the assessment supports them rather than converting a general expectation into a personal schedule.
