Personal household items should be distinguished from assets used in the commercial enterprise. Moving them with business equipment does not establish a qualifying investment or change family immigration eligibility.
Separate shipment records by purpose
Keep an asset schedule identifying business use and ownership, alongside the family’s own travel and relationship documents. A spouse and unmarried children under 21 may seek E-2 dependent status. A spouse in valid E-2 or E-2S status is generally work authorized incident to status; children are not.
If family members will operate machinery, their actual authorization and applicable workplace requirements need separate attention. Separate the two shipments before either is packed rather than after they arrive. Hypothetical example: a household relocating for a repacking venture loads domestic furniture and processing equipment into the same container.
Once combined, the consignment produces a single set of documents from which the business contribution must afterwards be extracted, and the extraction is never as clean as the separation would have been. Prepare a business asset schedule and a household inventory as distinct records from the outset, each with its own valuation basis and ownership evidence. The principal’s spouse, and children who are both unmarried and younger than 21, may request dependent E-2 classification.
Valid E-2 or E-2S status generally authorizes a qualifying spouse to work incident to status, but gives no employment authorization to a dependent child. If a family member will operate equipment, confirm that person own authorization and the applicable workplace requirements before the line runs, separately from the investment analysis.
