Should an E-2 application target the next peak season?

THE DIRECT ANSWER

The commercial season can inform planning, but it cannot determine government processing. Work backward from actual opening dependencies while allowing for document preparation, the selected application process and unresolved travel authorization.

Prepare evidence before the window narrows

Existing operators should collect full-cycle records before relying on forecasts for the next season. Identify which supplier or staffing commitments begin before the investor can work in the United States, and who can lawfully manage them. If the intended opening window is missed, update the budget and plan instead of retaining assumptions that no longer fit the business calendar.

Preparing to a peak season is a common instinct and it creates a hard deadline where none was necessary. Consider instead what the applicant would do if the timing slipped past the season, since that scenario has real consequences for a business whose year is concentrated: a missed opening may mean a full year without revenue while fixed costs continue. Establish whether the enterprise can be operated by someone else in the interim, whether the season can be partially served, or whether the plan should assume a later start.

Then prepare the evidence well before any window narrows, so that the case is ready and the timing becomes a choice rather than a race. Consular procedures and appointment availability are not within the applicant's control and should not be built into a seasonal deadline.
