When must new-office premises be secured?

THE DIRECT ANSWER

The new-office petition needs evidence that sufficient physical premises have been secured. Do not assume an intention to find space after approval will satisfy that requirement.

Sequence the launch carefully

Coordinate the occupancy arrangement with the filing plan, proposed business activity and financial commitments. A delayed opening or changed site may require revised evidence and legal review. The one-year managerial-support requirement runs from petition approval, so counsel should help align launch milestones with that framework.

Government processing and any travel steps still need separate allowance; signing a lease does not establish a reliable arrival date. Sequence the launch so that the commitments with the longest tails come after the questions with the least certainty, wherever the business can tolerate it. Premises generally need to be secured rather than merely identified, so this is one of the commitments that has to be made early, which makes the terms of that commitment worth negotiating carefully.

Ask whether a shorter initial term, a break right or a conditional arrangement is available. Then work out what else depends on the premises — equipment delivery, fit-out, permits, the first hires — and identify which of those can wait. Where a landlord requires a fixed commencement, understand what the company is exposed to if the immigration timetable moves, since it will be the company rather than any adviser that carries that risk.
