Tracking document dependencies before a proposed TN start date
A start date can arrive before the supporting record is ready. Build a dependency list showing which evidence is missing, who can supply it and which decisions depend on its review. The list should expose uncertainty rather than turn an employer’s preferred date into an assumed authorization date. The first review should identify the professional category, proposed duties, citizenship evidence, and qualification standard before anyone chases every possible attachment. The resulting list should say which missing record determines eligibility, which merely improves presentation, and whether the intended work structure raises a separate route concern.
WHAT THIS GUIDE COVERS
- Identify blockers rather than counting documents
- Assign a source and a follow-up date
- Keep the employer informed through factual updates
- Hypothetical example: naming the blocker rather than counting the file
Which facts belong in a first consultation for a Canadian PR?
Begin with your actual citizenship, Canadian residence status and intended U.S. activity. Add the real opportunity and the question you need answered. Those facts help separate nationality, work eligibility and procedure without requiring a public enquiry to contain your passport, financial records or complete immigration history. The first review should produce a short fact map: present citizenship, Canadian status, the U.S. activity, the proposed employer or enterprise, and the family timing. That map prevents a permanent-residence card from being mistaken for nationality and tells the adviser whether the next record should be a passport, offer, corporate document, or status history.
WHAT THIS GUIDE COVERS
- Prepare a concise personal outline
- Describe the opportunity concretely
- Choose the main decision
- Hypothetical example: choosing the one decision worth taking away
How should contractor deposits enter an E-2 budget?
A contractor quote, signed service agreement and paid deposit provide different evidence of commitment. Review deliverables, cancellation terms and actual payments before counting them. The budget should also explain how outsourced work enables the investor’s enterprise to operate, rather than treating a large vendor contract as sufficient proof of investment or direction. The first review should reconcile the source of funds, each transfer, the contractual commitment, and the operating purpose of the expenditure. It should also state the decision still to be made: whether the payment is sufficiently exposed to commercial loss, whether it belongs to the enterprise, or whether the model can support a non-marginal operation under the investor's direction.
WHAT THIS GUIDE COVERS
- Match the payment to deliverables
- Separate completed work from future fees
- Retain the investor’s directing role
What should a new office retain for the extension review?
Initial new-office approval is limited to one year, making recordkeeping part of the launch rather than a last-minute project. Preserve evidence of actual operations, staffing, duties and finances as they develop. The extension discussion should address the business that exists, including meaningful differences from the original plan. A new-office review should first confirm the qualifying relationship and the transferee's uninterrupted qualifying year abroad during the three years before filing. The initial approval is limited to one year, so the launch plan should identify the records that will later show real operations, the executive or managerial capacity, and continued activity abroad; L-1A and L-1B maximum periods are normally seven and five years respectively.
WHAT THIS GUIDE COVERS
- Start from the submitted commitments
- Collect ordinary business evidence
- Review deviations before the deadline
- Hypothetical example: knowing when a deviation needs raising
Does choosing a branch instead of a subsidiary favour L-1 over E-2?
A branch and a separately incorporated subsidiary create different records, but neither label alone determines the visa category. L-1 examines the qualifying organization and transfer; E-2 examines nationality, investment and direction. Review the legal entity, ownership and capital flows before assuming a particular corporate form guarantees or excludes either route. The first review should produce two separate evidence maps rather than a blended comparison. For L-1, test the related entities, the transferee's uninterrupted qualifying foreign employment year within the prior three years, and the proposed qualifying role. For E-2, test treaty nationality, ownership, capital placed at genuine commercial risk, investor direction, and a business that is not marginal.
WHAT THIS GUIDE COVERS
- Explain the L-1 relationship precisely
- Trace E-2 nationality and investment through the form
- Choose structure with coordinated advice
What should we revisit when another child joins the family plan?
Adding a child to the relocation plan requires an individual review rather than copying a sibling’s assumptions. Confirm the child’s nationality, relationship, age and intended timing under the principal’s route. The family’s existing approval or preparation history does not automatically settle the new child’s status, visa or documentation questions. The first review should result in an individual fact sheet for the child: relationship records, nationality, age on relevant dates, current status, intended travel, and the principal's exact classification. The concrete decision is whether the child can be included under that route now, needs a separate procedural step, or has a timing issue that should be addressed before housing or school commitments are made.
WHAT THIS GUIDE COVERS
- Update the household outline
- Review the relevant dependent framework
- Coordinate the revised timeline
- Hypothetical example: what a new arrival changes
How do later immigration obligations differ?
EB-5 includes conditional permanent residence and a subsequent removal-of-conditions process. Gold Card is described through a different existing-classification framework and should not be assumed to use the same investment follow-up. Compare the entire immigration path, while avoiding a promise that obtaining either status removes all future legal obligations. The first review should make the choice concrete: identify the EB-5 capital path, records concerning required job creation, and the future conditional-residence stage, then separately identify the Gold Card instruction and payment record. EB-5 capital must be at risk and the resulting residence is conditional at first; Gold Card requires a gift by the applicant to the Department of Commerce, deposited in a separate Treasury fund, and is never a conventional visa.
WHAT THIS GUIDE COVERS
- Map the EB-5 follow-up
- Identify Gold Card’s actual framework
- Budget for administration and advice
- Hypothetical example: comparing what each route asks of you later
