FOR IMMIGRANT INVESTORS · PICKERINGPickering

Invest in anew chapter.

For applicants in Pickering, this guide focuses on investors who already hold, or may seek, temporary U.S. status. An EB-5 petition does not replace the separate rules governing admission, employment, travel or adjustment eligibility. EB-5 planning should begin with the investment path, source and movement of capital, and the project records that address required job creation. Capital must be placed at risk; a successful case leads first to conditional permanent residence, not an immediate end to later compliance and recordkeeping.

IN THIS GUIDE · EB-5 filing while holding temporary U.S. status

Start with the EB-5 eligibility and application overview

01

Inventory the current immigration position

Collect status documents, admission records, work authorization and relevant travel history before planning a transition. Identify expiry dates and any conditions on employment. A valid visa stamp and an authorized period of stay are different records. Counsel should review the actual status history rather than assume that being physically in the United States makes an EB-5 adjustment filing available. Build a timeline from the investor's existing status documents, intended filings, and the commercial events that could change travel or work plans. The first review should identify which action needs separate authorization instead of assuming the petition settles it.

02

Separate petition from work permission

Submitting an investor petition does not itself authorize U.S. employment. Managing a funded enterprise on site may raise a separate work question before residence is granted. Review the activities the investor and spouse intend to perform and the authorization each currently holds. Investment ownership, a pending case and an eventual plan to immigrate should not be treated as interchangeable permissions. Separate passive ownership from activities that could be work in the United States. A current status document, employment authorization record, and description of the proposed activity answer different questions and should be reviewed together before the investor acts.

03

Assess the residence route individually

Consular processing and adjustment of status involve different eligibility and procedural requirements. Some eligible EB-5 applicants may have filing options linked to visa availability, but there is no universal rule that an investment lets someone adjust immediately. Give counsel the complete admission and status history. Review any proposed travel or new application before relying on an assumed transition strategy. Compare the actual admissions history with the contemplated procedural route before any travel or status change. The decision is fact specific: the relevant record is usually the admission document and supporting history, not a general account of what another investor did.

04

Track dependent status independently

A spouse or child may have temporary status tied to a principal’s employment or another basis. Starting EB-5 does not automatically extend it. Maintain each family member’s documents and deadlines, and review children’s age issues under both the existing arrangement and the immigrant process. Coordinate the transition without assuming that one pending petition protects every person’s stay or work rights. Create a family calendar that lists every person's expiry, travel plan, school timing, and work question. Conditional residence and derivative planning do not erase a separate temporary-status deadline that arrives earlier.

05

The line between planning and acting

Holding temporary status while an immigrant case is pending creates a specific risk, because the two positions are governed separately and the moment of greatest danger is when someone acts on the immigrant case as though it had already changed the temporary one. Set the threshold there. Planning, funding, incorporating, negotiating and preparing evidence are ordinarily consistent with maintaining an existing status. Beginning operational work, changing employer, altering the pattern of activity or allowing an authorization to lapse are decisions to put in front of counsel first, with the actual tasks, the location and the proposed start date described. Filing an investor petition supplies no work authorization, and no expectation of a later approval changes what the current status permits today.
