Participation in development can support specialised knowledge, but it is not automatic qualification. The employer must explain the employee’s actual understanding and show that the proposed U.S. role involves it.

Identify the specific development or implementation work and the capabilities gained, supported by records and knowledgeable explanations. A product creator may have relevant expertise without satisfying every other requirement, so confirm qualifying foreign employment and the related businesses. A patent, launch announcement or impressive job title cannot replace the full eligibility analysis.
The characteristic failure here is a file that proves the team was impressive rather than proving what this person knows. Development participation is described collectively, the transferee appears in a list of contributors, and no record attributes a specific capability to them. Hypothetical example: a telehealth platform submits release notes naming a department rather than a person, and when asked what the transferee personally understands, the employer has to construct the answer from recollection long after the work was done.
A second failure is treating eligibility as settled once knowledge is established, when the qualifying year abroad, the continuing corporate relationship and the specific U.S. duties each still have to be shown. Rebuilding attribution evidence late is slower and less convincing than recording it while the work happens.
