FOR IMMIGRANT INVESTORS · OSHAWAOshawa

Invest in anew chapter.

This Oshawa guide separates petition processing from immigrant visa availability. Canadian residence or citizenship does not automatically determine the visa queue; the applicable country of chargeability and category need review. The first review should produce a dated route map: category, chargeability, priority-date position, capital source and path, and the family members whose timing needs attention. It should also distinguish investment documents from immigration milestones. EB-5 requires qualifying capital exposed to loss and the required job creation; residence obtained through the route is conditional at first, so later removal-of-conditions evidence belongs in the plan from the outset.

IN THIS GUIDE · Visa availability and country of chargeability

Start with the EB-5 eligibility and application overview

01

Identify the correct chargeability

Immigrant visa chargeability is generally connected to country of birth, with exceptions that counsel can assess. Do not assume that becoming Canadian or living in Ontario automatically places the investor in a particular queue. Collect birth information for the principal and spouse, and identify the relevant EB-5 category before interpreting a Visa Bulletin chart or a project’s timing claim. Collect birth records before relying on nationality shorthand, then ask counsel to identify chargeability and any applicable exception. The concrete decision is which Visa Bulletin column is relevant, not which passport feels most connected to the family. Hypothetical example: an investor who sold an optical-coating supplier should keep the sale record separate from the birth record that informs chargeability.

02

Distinguish approval from availability

USCIS can adjudicate a petition while a separate question remains about visa availability for residence. An approved petition does not necessarily mean an immigrant visa can be issued immediately. Track the priority date and applicable official bulletin information with counsel. Avoid turning a general processing estimate into a prediction that all immigration stages will finish at the same time. Maintain a chronology with petition filing, priority date, notices, and any visa-availability step in separate rows. That makes it clear what an approval establishes and what it does not. Do not sign a relocation contract because a project representative blends these events into one predicted date.

03

Read reserved-category claims carefully

The EB-5 programme has category distinctions that can affect visa allocation. A project’s qualification and the investor’s applicable category should be verified before relying on a statement about availability. A current chart is a dated snapshot, not a guarantee of future conditions. Review the actual petition strategy and official instructions rather than assuming a category label creates a permanently open route. Ask a project to identify the factual basis for any reserved-category statement and preserve the answer with the offering records. Category availability can change, and project marketing does not alter the official allocation rules. The decision is whether the category has been verified for this investor before capital is committed.

04

Connect availability to family planning

Changes in visa availability can matter for family sequencing and child age-protection analysis. Keep the spouse’s and children’s documents ready without assuming residence dates are fixed. The immigration route also affects which official instructions govern next steps. A petition receipt, project completion or Canadian passport does not independently authorize the family to move permanently to the United States. For every family member, record the document needed next and the event it depends on. Conditional residence is not the end of the evidence task: job-creation and investment-related records may later matter. Avoid scheduling a child’s move around a projection that no government notice has confirmed.
